These Terms of Service (“Terms”) explain how you may use Remerie and our services (the “Services”). By accessing or using the Services, you agree to these Terms.
If you do not agree, please do not use the Services.
1. The Services
Remerie provides personalised, interactive digital keepsakes. The Services include:

Digital templates

Tools to upload images, videos, audio, and text

Hosting and delivery of keepsakes via shareable links

Customer support and related features
We may update or improve the Services from time to time.
2. Eligibility
The Services are intended for general audiences.
If you are under 16 years of age, you may use the Services only with the permission and involvement of a parent or legal guardian.
By using Remerie, you confirm that you have the legal capacity to agree to these Terms and, where applicable, to upload content involving other individuals.
3. User-Generated Content
Remerie allows you to upload images, videos, audio, text, and other materials (“User-Generated Content”).
Ownership
You retain full ownership of all User-Generated Content you upload. Remerie does not claim ownership over your content.
Licence to Operate the Services
By uploading User-Generated Content, you grant Remerie a limited, non-exclusive licence to store, use, display, and process the content only as necessary to operate, deliver, maintain, and support the Services.
This licence ends when your content is deleted from our systems.
Your Responsibility
You are responsible for ensuring that:

You have the legal right and necessary consent to upload the content

Your content does not infringe the rights of others

Your content complies with applicable laws
Remerie does not review or monitor content before it is uploaded.
4. Privacy
Your privacy matters to us. Our collection and use of personal information is explained in our Privacy Policy, which forms part of these Terms.
5. Payments
Prices are displayed at checkout.
All payments are processed securely through Shopify or other payment providers. Remerie does not store your full payment details.
All purchases are final unless stated otherwise or required by law.
6. Access, Sharing, and Retention
Remerie keepsakes are accessed via private shareable links.
Anyone with access to a link may be able to view the content contained within the template. You are responsible for how and with whom links are shared.
User-Generated Content is stored in accordance with our retention practices, generally for up to five (5) years from the last time the link is accessed, unless deleted earlier at your request or required by law.
7. Acceptable Use
You agree not to:

Upload content that is illegal, harmful, or infringes the rights of others

Attempt to interfere with, hack, or disrupt the Services

Use the Services for unauthorised commercial or unlawful purposes

Misuse or attempt to access content that does not belong to you
We reserve the right to remove content or restrict access where necessary to protect the Services or comply with legal obligations.
8. Suspension and Termination
We may suspend or terminate your access to the Services if:

These Terms are breached

The Services are misused

Required by law or for security reasons
Where reasonably possible, we will provide notice before taking action.
9. Disclaimer
The Services are provided on an “as is” and “as available” basis.
While we take reasonable steps to keep the Services secure and functional, we do not guarantee that the Services will be uninterrupted, error-free, or completely secure.
You use the Services at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law:

Remerie is not liable for indirect, incidental, special, or consequential loss or damages

Remerie is not responsible for loss of content resulting from link sharing, user actions, or circumstances beyond our control
Nothing in these Terms limits rights that cannot be excluded under Australian Consumer Law.
11. Changes to the Services or Terms
We may update the Services or these Terms from time to time.
Updated Terms will be posted with a revised “Last updated” date. Continued use of the Services after changes take effect means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of Australia.
Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
